Terms & Conditions.
These terms govern your use of homeby.party (the "Site"), your SMS conversation with our assistant Lucy, and your attendance at Home By events. By submitting your phone number, texting Lucy, purchasing a ticket, or attending an event, you agree to these terms. If you don't agree, don't use the Site.
Who we are
Home By is operated by HOMEBYHOSPITALITY LLC, a limited liability company based in Chicago, Illinois. Contact: human@homeby.party.
The service
Home By is a small invite-only event series. We use SMS to communicate with you about events, confirm signups, share event locations, and sell tickets. Participation is entirely optional.
SMS communications
You consent to receive recurring automated SMS from Home By about our events by checking the optional SMS opt-in checkbox on our sign-up form. Checking that box is not required to submit the form. Message frequency varies. Message & data rates may apply from your carrier.
You can opt out any time by replying STOP. Reply HELP for help or email human@homeby.party. See our Privacy Policy for how we handle your data.
Tickets, payments, and refunds
- Ticket prices are shown at checkout. Payments are processed by Stripe.
- Tickets are non-refundable except where required by law. Events happen rain or shine, and entry is at our discretion.
- Each ticket includes a unique QR code texted to you after purchase. Don't share it — only the first scan is valid.
- If we cancel an event for any reason, we'll refund your ticket in full.
- Reselling tickets is prohibited. Tickets obtained through resale may be invalidated at the door.
Age & entry requirements
Home by 11 (indoor, ticketed) is 21+. Valid government-issued ID is required at the door. If you're under 21, don't buy a ticket — you won't be let in and the ticket won't be refunded.
Home by Dusk (outdoor park party) is free and all-ages. Kids and dogs welcome. Parents supervise their kids; owners supervise their dogs.
We reserve the right to deny entry to anyone for any lawful reason, including intoxication, hostility, or violation of our code of conduct below.
Code of conduct
Home By is for people who want a good night and are cool about it. At our events:
- No harassment, discrimination, violence, or threats — toward staff, guests, neighbors, or venues.
- No illegal drugs on premises.
- Respect the venue and clean up after yourself, especially at Home by Dusk.
- If staff or security ask you to do something, do it.
Violating this code gets you removed without a refund, and possibly permanently uninvited from future events.
Your SMS with Lucy
Lucy is a conversational AI assistant. She is not a human. We store your SMS exchanges with her so she can remember you across conversations and so we have a record of your opt-in. Don't send anything to Lucy you wouldn't want us to see. Don't send Lucy anything illegal. We reserve the right to ignore, block, or flag accounts that send abusive or spammy messages.
Intellectual property
The Site, the "Home By" name, the Home By marks, the writing, the photos, and the look & feel belong to us. Don't copy them for commercial use without permission. Reach out — we might say yes.
Disclaimer
The Site and our events are provided "as is." We don't make guarantees about uninterrupted service, uptime, or that Lucy will always say something clever. You attend events at your own risk. We're not responsible for lost or stolen belongings, injuries you cause yourself or others, or transportation to and from.
Limitation of liability
To the maximum extent allowed by law, our total liability to you for anything related to the Site, SMS communications, or an event is limited to the amount you paid us (if anything) in the 90 days before the issue. We're not liable for indirect, incidental, or consequential damages.
Governing law
These terms are governed by the laws of the State of Illinois. Any dispute that can't be resolved informally will be resolved in the state or federal courts located in Cook County, Illinois.
Changes to these terms
If we update these terms, we'll change the "Last updated" date above. If the changes are material, we'll let you know by SMS before they take effect. Continued use of the Site after changes means you accept them.
